Agreement Signed between the State Hermitage and Cameo Ltd On 4 November 2004 the State Hermitage and Cameo Ltd concluded an Agreement according to which the Hermitage does not object to the registration of an image (the Gonzaga Cameo) as a trade mark by Cameo Ltd and also accepts the prolongation of this right for a further 10-year period. The famous Gonzaga Cameo is a masterpiece of ancient art which belongs to the Museum Fund of the Russian Federation and is registered in the inventory books of the State Hermitage's Department of the Ancient World. It is among the items on permanent exhibition in the museum. On the basis of the Russian Federation Law "On Trade Marks, Service Marks and Place Names of Goods" dated 17 October 1992, in the year 2001 the Russian Patent and Trade Mark Agency granted Cameo Ltd a "Certificate of Registration" for a trade mark depicting the Gonzaga Cameo to be used on confectionery goods However, the Russian Federation Law "On Trade Marks, Service Marks and Place Names of Goods" stipulates that the use and registration of trade marks having images of cultural treasures that are held in the collections of museums requires the agreement of official representatives of the institution owning these treasures. In keeping with these facts, the State Hermitage and Cameo Ltd concluded an Agreement according to which the State Hermitage does not object to the registration of a depiction of the Gonzaga Cameo as a trade mark and also accepts the prolongation of this right for a further 10-year period. In turn the Company provides assurances that the trade mark will be used only with respect to goods and services specified in the Agreement. Separate contracts with Cameo Ltd set out their obligations to render sponsorship support to the State Hermitage in a number of different museum programs, to participate in developing and financing special projects, and also to bear certain costs in the production of assortments of candies under the Hermitage name for the museum's use as presents (developing and producing the labels). |
